AND: Story Telling Industries in the State of New South Wales of the second part

THE PARTIES AGREE AS FOLLOWS:

INTERPRETATION

In this agreement the following definitions apply: 'The Work' means the [form of material script, treatment, play, manuscript, story, idea] written by the Author/s and entitled "[Name of Work]"; A reference to a person includes corporations; words including singular number includes plural numbers; words including gender includes all genders. Except for the purpose of indentification headings have been inserted in this Agreement for the purpose of guidance only and are not part of this Agreement.

RELEASE

I understand that story telling will be evaluating the material as a basis for providing services to me. I understand that you and your consultants read and receive, or have created ideas, themes, formats, and/or other materials which may be similar to the themes, plot, ideas, format or other elements of the material now being submitted, and I agree that I will not be entitled to any compensation by reason of use of such material. I warrant that I am the owner of the copyright in the work and that I have full right and authorization to submit this material. I am the sole author (unless otherwise stated in writing) of the material submitted and the sole owner of all rights, title and interest in and to the material (including copright). I will indemnify story telling against any loss, injury or damage (including any legal costs or expenses property incurred) occasioned to story telling in consequence of any breach by me of this warranty. I acknowledge no fiduciary relationship now exists between us and you shall be under no obligation to us with respect to the material submitted. I understand that story telling is a consulting service which assists in drafting, editing and improving materials submitted to it. The parties agree that the material submitted remains the property of the authors and the authors retain the copyright to that material.

GENERAL

Applicable law This agreement must be read and construed according to the laws of the State of New South Wales, Australia and the parties to submit to the jurisdiction of that State. Ammendments This agreement may not be varied except in writing signed by both the parties. Severability If any provision of this agreement is held by a court to be unlawful, invalid, unenforceable or in conflict with any law, statute, ordinance or regulation it is severed so that the vailidity and enforceability of the remaining provisions are not affected. Further Agreements Each party must do all such acts and execute all such documents as neccessary to give effect to this agreement.
